Protecting Senior Assets
Question: I didn’t read all of the other posts, but I can imagine the kinds of crap some of them might contain. Just ignore those.
As far as your situation, you really should use some of the money to pay for a consultation with an attorney in your state that specializes in elder law and protection of assets of the elderly. It is obvious that you are not going to end up with any money out of this process.
Answer: Instead of a Bankruptcy Reform Bill, what we really need is a Family Trust Reform Bill that would change this situation. I’m not going to read the rest of your message. I am a lawyer. You may or may not like lawyers, but the fact is that my job is to take the facts my client gives me, and elicit more facts that s/he hasn’t given me that will get him or her the benefit of the law as enacted by duly elected legislators.
Those who don’t like the law should refer to their legislators, not to me. Those who read postings restrictively with a “gotcha” state of mind are not worth paying attention to.
My advice was correct: see a specialist elder law attorney. Mom may have rights that neither you nor she is aware of.
Vote for Bush if you like. Promote the Bankruptcy deform law that ends bankruptcy law as we have known it for a hundred years. Bring back debtors’ prison. And when, through misadventure, you fall on hard times, don’t expect any mercy.
